Pre-Information and Distance Sales
1. Who is the sale between?
When you buy with a PayDM payment link, the sales contract is formed between the buyer and the seller who sent the link. [company name] is an intermediary service provider; it runs the secure holding of the payment, order tracking and the dispute process, and is not a party to the sale.
2. A form for each order
On the payment page, before paying, the Pre-Information Form and Distance Sales Contract filled in with that order's details opens and is approved separately. The form includes:
- If the seller carries on a commercial activity, their trade name, full address, phone, email and tax details.
- The product's name, description and images; its price including taxes, the shipping fee and the total amount.
- The payment method, the latest shipping time and the delivery terms.
- The right of withdrawal, the cases where it cannot be used, the return process and ways to complain.
After payment, the approved form is kept on the order page and sent to the buyer's email address (Regulation art. 7, durable medium).
3. If the seller is a merchant or tradesperson
The buyer counts as a consumer and consumer law applies. The buyer may withdraw within 14 days from the day they receive the product without giving a reason; the exceptions in Regulation art. 15 are reserved. The seller refunds the price within 14 days after receiving the notice of withdrawal; if they have not named a carrier for the return, they also cover the return shipping cost. For a defective product, the buyer has the optional rights in article 11 of Law No. 6502.
4. If the seller is a private individual
The right of withdrawal under consumer law does not apply to sales between people who are not acting for commercial or professional purposes. In this case, the buyer's protection is PayDM's approval and problem reporting process: if the product does not arrive as described, a problem is reported before approval and the price is not transferred to anyone until a decision is made.
5. Delivery and returns
Delivery times, refunds for orders that are not shipped and how a refund reaches your card are explained in the Delivery, Cancellation and Return Terms.
6. Complaints and applications
Complaints can be sent from the order page or to [email]. Consumers may apply to the consumer arbitration committee within the monetary limits set each year by the Ministry of Trade, and to the consumer court above those limits.
